Terms of Service — BiasharaMkononi POS

1. Acceptance of Terms

By downloading, installing, or using BiasharaMkononi POS ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms apply to all users of the App, including business owners and cashier staff.

2. Description of Service

BiasharaMkononi POS is a point-of-sale application that allows small businesses to:

  • Record and manage sales transactions
  • Manage product catalogues and stock
  • Manage one or more shop profiles
  • Print and share receipts
  • Sync business data across multiple devices

The App operates in an offline-first mode. Core functionality is available without an internet connection. Cloud sync requires internet connectivity.

3. Account Registration

To use the App, you must sign in with a valid Google account. You are responsible for:

  • Maintaining the security of your Google account
  • All activity that occurs under your account
  • Ensuring that anyone who uses the App through your account (such as cashier staff) complies with these Terms

You must be at least 18 years old to create an account.

4. Subscription Plans and Limits

The App offers tiered subscription plans (FREE, BASIC, PRO) with different limits on the number of shops and products. Plan limits are enforced by our backend server.

  • FREE plan: 1 shop, up to 100 products per shop
  • Higher plans are available with expanded limits

Plan limits are subject to change with reasonable notice. We will notify you of any changes that affect your current plan.

Exceeding plan limits requires upgrading to a higher plan before adding additional shops or products.

5. Acceptable Use

You agree to use the App only for lawful business purposes. You must not:

  • Use the App to process fraudulent transactions
  • Attempt to reverse engineer, decompile, or modify the App
  • Attempt to gain unauthorized access to our backend systems
  • Use the App in any way that could damage, disable, or impair our servers or services
  • Share your account credentials with unauthorized parties

6. Your Data

You retain ownership of all business data you enter into the App, including your product catalogue, sales records, and shop information.

By using the App, you grant FlavixLabs a limited license to store, process, and transmit your data solely for the purpose of providing the App's functionality. We do not claim ownership of your business data and will not use it for any purpose beyond operating the App.

You are responsible for the accuracy of the data you enter. BiasharaMkononi POS is a tool — it records what you enter. We are not responsible for errors in your records that result from incorrect data entry.

7. Financial Records Disclaimer

The App is designed to help you record and manage your business transactions. However:

  • The App is not a certified accounting system and should not be used as your sole financial record
  • Tax compliance remains your responsibility
  • We recommend keeping independent backups of your financial records
  • Receipt numbers generated by the App are for your internal reference only

Always consult a qualified accountant or tax professional regarding your legal obligations.

8. Receipt Printing

Receipt printing is provided as a convenience feature. FlavixLabs is not responsible for:

  • Printer hardware compatibility beyond supported devices
  • Print quality or paper supply
  • Receipts that fail to print due to connectivity, battery, or hardware issues

Always verify that a receipt has printed successfully before completing a customer transaction.

9. Sync and Data Availability

The App syncs your data to our servers when an internet connection is available. While we take reasonable measures to ensure reliability:

  • We do not guarantee 100% uptime of our backend services
  • Temporary sync failures are expected behavior — data queues locally and syncs when connectivity is restored
  • We are not liable for data loss resulting from device failure, uninstallation without syncing, or loss of your Google account access

We strongly recommend ensuring your device syncs successfully before switching devices or reinstalling the App.

10. Intellectual Property

The App, including its design, code, and branding, is owned by FlavixLabs. These Terms do not grant you any rights to use FlavixLabs trademarks, logos, or branding.

11. Termination

We reserve the right to suspend or terminate your account if you violate these Terms or engage in activity that harms other users or our systems.

You may terminate your account at any time from within the App. Upon termination, your data will be removed from our servers in accordance with our Privacy Policy.

12. Disclaimer of Warranties

The App is provided "as is" without warranties of any kind, either express or implied. We do not warrant that:

  • The App will be error-free or uninterrupted
  • The App will meet your specific business requirements
  • Data sync will occur within any specific time frame

13. Limitation of Liability

To the maximum extent permitted by applicable law, FlavixLabs shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of business data, lost profits, or business interruption.

Our total liability for any claim arising from the use of the App shall not exceed the amount you paid for your subscription in the 3 months preceding the claim.

14. Governing Law

These Terms are governed by the laws of the United Republic of Tanzania. Any disputes shall be resolved in the courts of Tanzania.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of significant changes through the App or by email. Continued use of the App after changes constitutes acceptance of the updated Terms.
